1. Overview
Welcome to Darkmoon Designs.
Throughout this website, the terms we, us and our refer to Darkmoon Designs.
By visiting our website or purchasing from us, you agree to be bound by these Terms and Conditions, along with any policies referenced here, including our Privacy Policy and Refund Policy.
These terms exist to keep things clear, fair and vaguely sane. If you do not agree with them, please do not use our website or services.
2. About our products
We do our best to present our products accurately. However, colours and appearance may vary depending on your screen, lighting and the realities of handmade production.
Product descriptions, prices and availability may change at any time without notice.
We reserve the right to discontinue or limit any product at our discretion. Sometimes things simply run out, break, or rebel against existence.
3. Custom and hand painted orders
Some of our products are made or painted specifically to order.
For custom painted orders, including masks or items painted in colours, finishes or styles requested by the customer, our stated lead time is up to 4 weeks.
In many cases it will be completed sooner, but we quote up to 4 weeks to manage expectations and protect quality.
3.1 Non returnable custom items
Custom painted and personalised items are not eligible for return, refund or exchange under any circumstances, unless faulty.
This is in accordance with The Consumer Contracts Regulations 2013, Regulation 28(1)(b), which removes the right to cancel for goods made to the consumer’s specifications or clearly personalised.
Once work has begun on a custom painted order, it cannot be cancelled. At that point paint has been mixed and time has been sacrificed.
3.2 Artistic interpretation
By requesting a custom paint order, you acknowledge that artistic judgement may be required in certain areas of the design.
We will make every reasonable effort to follow your instructions as closely as possible. However, due to the handmade nature of our work, minor variations and creative decisions may sometimes be necessary.
By placing a custom painted order, you confirm that you understand and accept this, and that the item remains non returnable under the personalised goods exemption described above.
4. Quality control and handmade reality
Quality is our main priority. Every item is checked multiple times before dispatch. If we would not be happy receiving it ourselves, we will not send it out.
That said, we are a small human operation, not a factory full of precision robots. Occasionally, mistakes happen. If there is an issue with your order, please contact us and we will do our best to resolve it fairly and sensibly.
Many of our products are three dimensional printed, handmade, hand finished or hand painted. This means that minor variations, surface textures and visible layer lines are sometimes unavoidable and form part of the production process rather than defects.
If you are looking for perfectly uniform, factory smooth products with zero variation, our production methods may not be the right fit. We completely understand, but we are not IKEA.
5. Orders
When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion.
Your order is confirmed once payment has been successfully processed and you receive an order confirmation email.
Please check your order carefully before submitting it. Once an order has been accepted, we may not be able to cancel or amend it.

Orders are for personal or household use only unless otherwise agreed in writing.
6. Prices and payment
All prices are shown in GBP unless stated otherwise.
Prices may change without notice. The price charged will be the price displayed at the time of purchase.
Prices do not include shipping, taxes, customs duties or import charges unless explicitly stated.
You agree to provide accurate billing and payment information and authorise us to charge the payment method provided.
7. Shipping and delivery
Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by couriers, customs processes, weather conditions or events outside our control.
Under UK consumer law, responsibility for goods remains with us until the goods are delivered to you, or to a person nominated by you to receive them.
Once delivery has been confirmed, responsibility for the goods passes to you.
If a parcel is lost or damaged in transit, please contact us as soon as possible so we can investigate with the courier and arrange an appropriate resolution where required.

8. Intellectual property and content use
Unless stated otherwise, all content on this website, including text, images, photographs, designs, graphics and product visuals, is created by Darkmoon Designs and remains our property.
You are welcome to share photos of your purchases on social media, show your friends, or generally admire your excellent taste.
You are not permitted to copy, reproduce, sell, distribute or commercially exploit our content, designs or images without our written permission.
In short, enjoy it, share it, talk about it, just do not nick it.
If you would like to use any of our content for commercial or promotional purposes, please contact us first. We are reasonable people and only mildly suspicious by default.
9. Use of the website
You agree not to use this website for unlawful, harmful or abusive purposes, or to infringe the rights of others.
We reserve the right to restrict or terminate access to the website if these terms are breached.
10. Third party services and links
Our website may contain links to third party websites or services. We are not responsible for their content, policies or practices.
Your use of third party services is at your own risk.
11. Feedback and reviews
If you submit reviews, feedback or suggestions, you grant us the right to use them for promotional or commercial purposes without compensation.
You confirm that any feedback you provide is truthful and does not infringe the rights of others.
12. Errors and omissions
We reserve the right to correct errors, inaccuracies or omissions and to cancel orders if information is incorrect at any time.
13. Liability and legal rights
We are responsible for supplying products that meet the standards required by UK law.
Nothing in these terms limits or excludes your statutory rights, including your rights under the Consumer Rights Act 2015.
To the fullest extent permitted by law, we are not liable for indirect or consequential losses, including loss of profit, loss of enjoyment or loss arising from use of our products beyond their intended purpose.
Our total liability in relation to any order will not exceed the value of the product purchased, except where UK law requires otherwise.
We hold appropriate public liability insurance. This does not remove your legal rights, but it does mean we take safety and responsibility seriously rather than hoping for the best.
14. Indemnification
You agree to indemnify and hold harmless Darkmoon Designs from any claims arising from your breach of these terms or misuse of the website.
15. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.
16. Changes to these terms
We may update these terms from time to time. The latest version will always be available on this page.
Continued use of the website constitutes acceptance of any updated terms.
17. Governing law
These terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
